Bank of America Short Term Disability Plan alleged to have wrongfully denied disability benefits

SAN JOSE – A woman alleges that she is disabled and unable to work but that her insurer wrongfully denied her benefits.

Maria Aguilar filed a complaint on Dec. 15 in the U.S. District Court for the Northern District of California, San Jose Division against Bank of America Short Term Disability Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2016, she became disabled and applied for disability benefits but was denied. The plaintiff holds Bank of America Short Term Disability Plan responsible because the defendant allegedly refused to pay plaintiff's disability benefits despite being disabled according to the terms of the plan.

The plaintiff seeks payment all benefits owed to her plus interest, all legal fees and any other relief as the court deems just. She is represented by James P. Keenley and Brian H. Kim of Bolt Keenley Kim LLP in Berkeley.
