Man claims HSBC Bank wrongfully foreclosed on property

LOS ANGELES – A Downey resident claims a financial institution wrongfully foreclosed on his property.

Fernando Avila filed a complaint on Dec. 19 in the U.S. District Court for the Central District of California against HSBC Bank alleging wrongful foreclosure, misrepresentation and fraud.

According to the complaint, the plaintiff alleges that he suffered damages from having his property wrongfully foreclosed after he was approved for a loan modification. The plaintiff holds HSBC Bank responsible because the defendant allegedly foreclosed plaintiff's property despite having all necessary documentations for his loan modification.

The plaintiff seeks request that the court void foreclosure, order that the court revert the property back to the plaintiff and that the loan modification as agreed be enforced. He is representing himself.
