LOS ANGELES – A Ventura clothing brand claims a Montana business is using its famous mark.
Patagonia Inc. filed a complaint on Dec. 22 in the U.S. District Court for the Central District of California against Generation Tee LLC, doing business as Montana Shirt Co. LLC, alleging trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business due to the confusion of the defendant's similarly labeled Montanagonia products being sold on the market. The plaintiff holds Generation Tee LLC, doing business as Montana Shirt Co. LLC, responsible because the defendant allegedly copied plaintiff's design elements and incorporated them on the logo of its products.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, all damages and profits plus interest, all legal fees and any other relief as the court deems just.
