Patagonia claims Wyoming company is using infringing logo on bumper stickers

Trademark 07

LOS ANGELES – A Ventura clothing company claims one of its logos is unlawfully being used on bumper stickers by a Wyoming company.

Patagonia Inc. filed a complaint on Dec. 27 in the U.S. District Court for the Central District of California, Western Division against TGT Inc. alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation. The plaintiff holds TGT Inc. responsible because the defendant allegedly continued to use and sell products that contain plaintiff's Fitz Roy logo despite its agreement with the plaintiff that the designs were discontinued.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, all damages and profits plus interest, all legal fees and any other relief as the court deems just. It is represented by Gregory S. Gilchrist and Ryan Bricker of Kilpatrick Townsend & Stockton LLP in San Francisco.
