Software engineer seeks disability benefits

SAN JOSE – A software engineer for Apple Computer alleges he is disabled and his claim for benefits was wrongfully denied.

Christopher Kane filed a complaint on Jan. 3 in the U.S. District Court for the Northern District of California against Cigna Corp., doing business as Cigna Insurance Group and Life Insurance Co. of North America citing the Employee Retirement and Income Security Act.

According to the complaint, the plaintiff alleges that in June 2015, he became disabled due to post-traumatic stress disorder as the result of his participation in the Iraq War and was paid short-term disability benefits until it was terminated in June 2016. He alleges he applied for long-term disability benefits the same month, but the claim was denied. The plaintiff holds Cigna Corp. responsible because the defendants allegedly denied plaintiff when he applied for long-term disability benefits despite still being disabled according to the terms of the policy.

The plaintiff seeks declaration that plaintiff is entitled to receive disability benefits, all legal fees and any other relief as this court deems just. He is represented by Frank E. Mayo in Los Altos.
