LOS ANGELES – A manufacturer of optoelectronic components is seeking declaration from the court regarding claims of patent infringement.
Unity Opto Technology Co. LTD filed a complaint on Jan. 6 in the U.S. District Court for the Central District of California against Cree Inc. seeking declaratory judgment.
According to the complaint, the plaintiff alleges that it suffered damages from being accused of infringing the '444 and the '067 patents by the defendant. It alleges that it has not infringed any valid or enforceable claims of these patents.
The plaintiff requests a trial by jury and seeks declare that the claims of Patent No. 8,998,444 and Patent No. 9,052,067 are invalid, declare that the plaintiff does not infringe any of the defendant's patents, all legal fees and any other relief as the court deems just.
