LOS ANGELES – A Huntington Beach fitness apparel business has filed suit against a North Carolina nutrition products company over allegations it uses a confusingly similar logo.
Live Fit Apparel LLC filed a complaint on Jan. 5 in the U.S. District Court for the Central District of California against Catapult Fit LLC, also known as Live Fit LLC and doing business as Live Fit Nutrition, alleging trademark infringement.
According to the complaint, the plaintiff alleges that Live Fit Apparel LLC suffered damages to its business. The plaintiff holds Catapult Fit LLC, also known as Live Fit LLC and doing business as Live Fit Nutrition, responsible because the defendant allegedly used the Live Fit mark of similar design to advertise its nutritional products.
The plaintiff requests a trial by jury and seeks restrain the defendant from further using plaintiff's mark, profit and damages, treble damages, punitive damages, all legal fees and any other relief as the court deems just.
