Western Skyways accused of returning airplane in defective condition

SACRAMENTO – Santa Cruz County owners of a Cessna airplane allege the plane was not returned to them in a manner that was airworthy after repairs.

John Cottle and Valley Fresh Produce Inc. filed a complaint on Jan. 11 in the U.S. District Court for the Eastern District of California against Western Skyways Inc. and Does 1 through 25 alleging breach of contract and other counts

According to the complaint, the plaintiffs allege that they suffered monetary damages from paying for the repair and service of their aircraft that was returned to them in a defective nature. The plaintiff holds Western Skyways Inc. and Does 1 through 25 responsible because the defendants allegedly breached their contractual agreement with the plaintiffs by failing to provide service and repairs to the plaintiffs' aircraft to make is airworthy.

The plaintiffs request a trial by jury and seek economic damages, general damages, all legal fees plus interest and any other relief as this court deems just. They are represented by Michael G. Marderosian and Heather S. Cohen of Marderosian & Cohen in Fresno.
