Man claims Life Insurance Co. of North America wrongfully terminated benefits after three years

SAN FRANCISCO – A Brentwood man alleges he is still disabled and that his insurer wrongfully terminated benefits.

David Tippitt filed a complaint on Jan. 11 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2013, he became disabled due to several health conditions and applied for long-term disability benefits but the benefits were terminated after three years. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny plaintiff's claim for disability benefits despite him still meeting the criteria for disability according to the terms of the plan.

The plaintiff seeks compensatory damages, all legal fees plus interest, and any other relief as the court deems just. He is represented by P. Randall Noah of Law Offices of P. Randall Noah in Orinda.
