SAN FRANCISCO – Three California residents allege that they were required to work 12-hour shifts and were never provided rest breaks.

Kyndl Buzas, Raudel Covarrubias and Daniel Runions filed a complaint on behalf of all similarly situated current and former employees on Jan. 12 in the U.S. District Court for the Northern District of California against Phillips 66 Co. and Does 1 through 10 alleging violation of California labor codes.

According to the complaint, the plaintiffs allege that they suffered damages from not being provided adequate rest periods and that the defendants allegedly failed to provide their employees accurate wage statements.

The plaintiffs request a trial by jury and seek all unpaid wages, damages, statutory and civil penalties, restitution, enjoin the defendant, disgorgement, all legal fees plus interest and any other relief as the court deems just. They are represented by Jay Smith and Joshua F. Young of Gilbert & Sackman in Los Angeles and Randy Renick and Cornelia Dai of Hadsell Stormer & Renick, LLP in Pasadena.
