Erickson Productions claims photograph was unlawfully used on website

SAN FRANCISCO – A Petaluma photographer alleges his photograph was used on a website without his permission.

Erickson Productions Inc. filed a complaint on Jan. 11 in the U.S. District Court for the Northern District of California against Retirement Plan Advisors Inc. and Turner + Cunniff Inc. alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its copyrighted images used without its consent. The plaintiff holds Retirement Plan Advisors Inc. and Turner + Cunniff Inc. responsible because the defendants allegedly used plaintiff's copyrighted photograph on a website without obtaining a license from the plaintiff.

The plaintiff requests a trial by jury and seeks injunction against the defendants from using plaintiff's photographs, order the defendants to deliver up for destruction all infringing materials, damages, punitive damages, exemplary damages, all legal fees and any other relief as the court deems just.
