Firstsource Advantage accused of making autodialed, abandoned calls

SAN DIEGO – An individual has filed a class-action lawsuit against a debt collector over allegations it made unwanted autodialed and abandoned calls to his phone.

Michael Doherty filed a complaint on behalf of others similarly situated on Jan. 10 in the U.S. District Court for the Southern District of California against Firstsource Advantage LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he suffered damages from receiving several unwanted phone calls from the defendant. The plaintiff holds Firstsource Advantage LLC responsible because the defendant allegedly kept on calling the plaintiff using an automatic telephone dialing system and left voicemails that either contained silence or hold music.

The plaintiff requests a trial by jury and seeks statutory damages, injunctive relief, and any other relief as the court deems just. He is represented by Joshua B. Swigart and Yana A. Hart of Hyde & Swigart in San Diego and by Daniel G. Shay of the Law Office of Daniel G. Shay of San Diego.
