LOS ANGELES – A Ventura County resident alleges he is still disabled and his long-term disability benefits were wrongfully terminated.
David Eigner filed a complaint on Jan. 10 in the U.S. District Court for the Central District of California against Hartford Life and Accident Insurance Co. and Does 1-10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in September 2010, he became disabled and suffered damages from having his long-term disability benefits terminated in February 2016. The plaintiff holds Hartford Life and Accident Insurance Co. and Does 1-10 responsible because the defendants allegedly terminated plaintiff's long-term disability benefits despite being eligible according to the terms of the plan.
The plaintiff seeks all benefits due to the plaintiff, continue to provide plan benefits to the plaintiff for as long as he remains disabled, all legal fees and any other relief as this court deems just.
