LOS ANGELES – A nonprofit organization in North Hollywood that feeds the hungry alleges another similar organization in Colorado is using its mark.
Food Forward Inc. filed a complaint on Jan. 10 in the U.S. District Court for the Central District of California against Growing Food Forward alleging trademark infringement.
According to the complaint, the plaintiff alleges it is the owner of the Food Forward mark and has used it since 2009. The plaintiff holds Growing Food Forward responsible because the defendant allegedly used the Food Forward mark in order to support its activities, which the plaintiff alleges can confusion among plaintiff's donors and sponsors.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, order the destruction of all infringing materials, compensatory damages, all legal fees, interest and any other relief as the court deems just.
