LOS ANGELES – Shosho Fashion Inc. and Ross Stores Inc. are accused unlawfully using a fabric design for clothing.
Unicolors Inc. filed a complaint on Jan. 10 in the U.S. District Court for the Central District of California against the Shosho Fashion Inc.; Ross Stores Inc., doing business as DD's Discounts; and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Shosho Fashion Inc.; Ross Stores Inc., doing business as DD's Discounts; and Does 1-10 responsible because the defendants allegedly sell garments made of fabrics that bear plaintiff's 402257 design.
The plaintiff requests a trial by jury and seeks enjoin the defendants from infringing plaintiff's designs, award all profits to the plaintiff, statutory damages, all legal fees plus interest and any other relief as the court deems just.
