Scrubs maker alleges Koi Design has infringed Sapphire mark

LOS ANGELES – A luxury scrubs developer alleges another clothing company has infringed its trademark.

Strategic Partners Inc. filed a complaint on Jan. 11 in the U.S. District Court for the Central District of California against Koi Design LLC alleging trademark infringement.

According to the complaint, the plaintiff alleges that it is the owner of the mark Sapphire Scrubs. The plaintiff holds Koi Design LLC responsible because the defendant allegedly misleads the public into believing that its products are associated with the plaintiff by using the confusingly similar mark Koi Sapphire.

The plaintiff requests a trial by jury and seeks enjoin the defendant, compensatory damages, statutory damages, punitive damages, exemplary damages, restitution, actual damages, disgorgement, royalty, all legal fees plus interest and any other relief as the court deems just.
