LOS ANGELES – A man alleges his claim for disability benefits was denied because it was not properly investigated.
Walter Hackett filed a complaint on Jan. 12 in the U.S. District Court for the Central District of California against Standard Insurance Co. and Does 1-50 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that he became disabled and applied for disability benefits but was denied in 2013 on the defendant's claim that he never applied for the insurance. The plaintiff alleges he enrolled in the plan's coverage in June 2012 and that premiums had been withheld from his paycheck.
The plaintiff seeks benefits due to the plaintiff, declare plaintiff's rights to receive future disability benefits, interest, all legal fees and any other relief as the court deems just.
