Consumer claims Express charges excessive shipping, handling fees

LOS ANGELES – An Orange County man alleges a company is making an unethical profit from its excessive shipping and handling fees and has filed a class-action suit.

Jim Reider filed a complaint on behalf of all others similarly situated on Jan. 23 in the U.S. District Court for the Central District of California against Express LLC and Does 1-10 citing the Unfair Competition Law and the Consumers Legal Remedies Act.

According to the complaint, the plaintiff alleges in 2016, he ordered a lightweight product from the defendant and was charged an additional $8 for shipping and handling. The plaintiff holds Express LLC and Does 1-10 responsible because the defendants allegedly charged excessive amounts for shipping and handling for plaintiff's product that was purchased from its website.

The plaintiff requests a trial by jury and seeks compensatory damages, full refund of the amount shipping and delivery charges, restitution, injunctive relief, all legal fees and any other relief as the court deems just. He is represented by Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys in Newport Beach.
