LOS ANGELES – A Montebello bakery alleges a New Jersey company is using its mark to sell baked goods.
Le Pafe Inc. filed a complaint on Feb. 8 in the U.S. District Court for the Central District of California, Western Division against Overseas Food Trading LTD and Does 1 through 10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that it is the owner of the Le Chef and Le Chef Bakery trademarks. The plaintiff holds Overseas Food Trading LTD and Does 1 through 10 responsible because the defendants allegedly are unlawfully using the Le Chef Patissier mark on its products, which the plaintiff alleges could cause confusion among customers.
The plaintiff requests a trial by jury and seeks injunction against the defendant from further using plaintiff's mark, $250,000 for damages, profits, treble damages, all legal fees and any other relief as the court deems just.
