Sirius XM accused of unlawfully calling consumers for solicitation purposes

LOS ANGELES – Five consumers allege Sirius XM Radio Inc. engages in an illegal telemarketing campaign.

Regina Martinez, Kevin Pine, Anthony Ercolani, Robert Schwartz and Sarah Schwartz filed a complaint on Feb. 6 in the U.S. District Court for the Central District of California, Western Division against Sirius XM Radio Inc. and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that they suffered damages from receiving several unwanted calls from the defendants without their consent. The plaintiffs holds Sirius XM Radio Inc. and Does 1-10 responsible because the defendants allegedly kept on calling the plaintiffs several times using an automatic telephone dialing system to convert their free Sirius subscription into a paid one.

The plaintiffs request a trial by jury and seek $500 in statutory damages, $1,500 in treble damages, and any other relief as the court deems just. They are represented by Tammy Hussin of Hussin Law in Encinitas.
