LOS ANGELES – A Downey consumer claims a debt collector continued to call her after she revoked her consent.
Leonela Aracely Valdez Herrera filed a complaint on Feb. 13 in the U.S. District Court for the Central District of California, Western Division against First National Bank of Omaha NA, alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that in 2016, she suffered damages from receiving several collection calls from the defendant. The plaintiff holds First National Bank of Omaha NA responsible because the defendant allegedly kept on calling the plaintiff despite her request to cease calling.
The plaintiff seeks statutory damages, punitive damages, interest, injunctive relief, all legal fees and any other relief as the court deems just. She is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
