Life Insurance Co. of North America alleged to have wrongfully terminated disability benefits

LOS ANGELES – A former process technician for Borden Cos. alleges his long-term disability benefits were wrongfully terminated.

James Lewis filed a complaint on Feb. 14 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled under the terms of the plan and was initially approved for disability benefits, but the defendant terminated the benefits in September 2014. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's disability benefits despite being disabled according to the terms of the plan.

The plaintiff seeks award of benefits not paid to him plus interest, determine that he is entitled to future disability benefits, all legal fees and any other relief as this court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
