LOS ANGELES – A former employee of Alliant Techsystems Inc. claims she is still disabled and that her disability benefits were wrongfully terminated.
Kathryn Flowers filed a complaint on Feb. 17 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2013, she became disabled and was initially approved to receive disability benefits until the benefits were terminated in September 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's disability benefits based on its claim that she is no longer disabled according to the terms of the plan.
The plaintiff seeks benefits not paid to her plus interest, determine the that the plaintiff is entitled to disability benefits for as long as she remains disabled, all legal fees and any other relief as the court deems just.
