LOS ANGELES – A West Covina man claims a debt collector continued to contact him after he instructed it to contact his attorney.
Adrian Alcaraz filed a complaint on Feb. 15 in the U.S. District Court for the Central District of California against Bank of America NA alleging violation of the Telephone Consumer Protection Act and other counts.
According to the complaint, the plaintiff alleges that in May 2016, he suffered damages from receiving several collection calls despite already filing for bankruptcy. The plaintiff holds Bank of America NA responsible because the defendant allegedly kept on calling the plaintiff to collect an alleged debt despite his request to speak to his attorney.
The plaintiff requests a trial by jury and seeks statutory damages, all legal fees and any other relief as the court deems just. He is represented by Veronica E. McKnight and Joshua B. Swigart of Hyde & Swigart in San Diego.
