Former employee alleges BNK Petroleum owes unpaid back wages

LOS ANGELES – A man alleges he was misclassified as an independent contractor while he was employed as a wellsite supervisor.

Steve Hernandez filed a complaint on behalf of others similarly situated on Feb. 16 in the U.S. District Court for the Central District of California, Western Division against BNK Petroleum (US) Inc. and Does 1-30 alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for the defendant from July 2014 to December 2014. The plaintiff holds BNK Petroleum (US) Inc. and Does 1-30 responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, unpaid benefits, all legal fees, interest, and any other relief as the court deems just. He is represented by Matthew S. Parmet of Bruckner Burch PLLC in Houston, Texas and Andrew W. Dunlap of Fibich, Leebron, Copeland, Briggs & Josephson in Houston, Texas.
