Consumer claims Stellar Recovery's payment fee violates collection laws

SAN FRANCISCO – A San Francisco woman alleges a debt collector tried to collect an unauthorized fee.

Liliana Martinez filed a complaint on Feb. 22 in the U.S. District Court for the Northern District of California against Stellar Recovery Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in June 2016, she suffered damages from receiving a collection letter from the defendant that listed a charge the plaintiff claims was not authorized. The plaintiff holds Stellar Recovery Inc. responsible because the defendant allegedly informed the plaintiff that she may be charged a convenience fee of $9.50 if she chose to pay her debt by phone using a credit/debit card or by check, and the plaintiff did not agree to this charge.

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. She is represented by Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
