Pac Bell sales rep alleges disability benefits owed

Insurance 03

SACRAMENTO — A Tracy man is suing Pacific Bell Telephone Company and Sedgwick Claims Management Services Inc., citing alleged breach of contract for terminating his long-term disability benefits.

Mario A. Nava, a sales representative with Pacific Bell, filed a complaint on Feb. 10 in the U.S. District Court for the Eastern District of California alleging that the defendants denied the plaintiff's claim for disability benefits.

According to the complaint, Nava alleges that, in July 2015, he became disabled due to several health conditions and was initially being paid disability benefits until they were terminated in October of that year. The plaintiff holds the defendants responsible because they allegedly terminated plaintiff's disability benefits despite having sufficient evidence to support his claim for disability.

The plaintiff seeks plan benefits still owing, all legal fees, interest and other relief. He is represented by Robert J. McKennon and Joseph S. McMillen of McKennon Law Group PC in Newport Beach.
