Consumer claims Capital One continued to call after she revoked consent

LOS ANGELES – A Montebello individual alleges a debt collector continued to call her after she asked for the calls to stop.

Ricela Ramirez filed a complaint on Feb. 22 in the U.S. District Court for the Central District of California against Capital One, National Association alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in 2016, she suffered damages from receiving several collection calls from the defendant. The plaintiff holds Capital One, National Association responsible because the defendant allegedly kept on calling the plaintiff using autodialed calls despite her request to stop calling on Nov. 9, 2016.

The plaintiff requests a trial by jury and seeks injunction against the defendant, $500 in statutory damages, treble damages in the amount of $1,500, statutory damages of $1,000, interest, all legal fees and any other relief as the court deems just. She is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
