LOS ANGELES – A Sacramento real estate brokerage is accused of using a trademarked sign design without permission.
RE/MAX LLC filed a complaint on Feb. 17 in the U.S. District Court for the Eastern District of California against ARE Group Inc., doing business as Amen Real Estate, and James Amen alleging trademark infringement and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its trademarked, tri-bar red, white and blue sign design used to advertise similar services by the defendant. The plaintiff alleges it has tried to resolve the issue with the defendants with no resolution.
The plaintiff requests a trial by jury and seeks enjoin the defendants, award monetary damages to the plaintiff, profits, exemplary damages, treble damages, interest, all legal fees and any other relief as the court deems just.
