Man alleges Liberty Life owes benefits at rate of more than $5,000 a month

SACRAMENTO – A Kern County man alleges his disability benefit claim was wrongfully terminated.

Larry Close filed a complaint on March 3 in the U.S. District Court for the Eastern District of California against Liberty Life Assurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled in 2015 and was initially approved to receive disability benefits until his claim was terminated in 2016. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly terminated plaintiff's disability benefits despite the defendant having medical evidence to support plaintiff's disability claim.

The plaintiff seeks damages, benefits payable at the rate of $5,044.51 per month, interest, all legal fees and any other relief as this court deems just. He is represented by Bernard R. Schwam of Law Offices of Bernard R. Schwam in Encino.
