Class action filed against Wells Fargo Home Mortgage over calls made for alleged debt

SAN DIEGO – Two individuals have filed a class-action lawsuit against a San Francisco debt collector alleging invasion of privacy.

Clarice M. Shadid and Lawrence D. Shadid filed a complaint on behalf of all others similarly situated on March 1 in the U.S. District Court for the Northern District of California against Wells Fargo Home Mortgage alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that in beginning in May 2014, Clarice M. Shadid received statements from the defendant claiming a balance that she disputed. The suit states the defendant began calling Clarice Shadid on her cellphone in May 2016 and that she revoked her consent to receive calls, and Lawrence D. Shadid was contacted in August 2016. The plaintiffs holds Wells Fargo Home Mortgage responsible because the defendant allegedly kept on calling the plaintiffs using an automated dialing system despite them verbally revoking their consent to be contacted.

The plaintiffs request a trial by jury and seek statutory damages, injunctive relief, and any other relief as the court deems just. They are represented by Abbas Kazerounian of Kazerouni Law Group APC in Costa Mesa and Joshua B. Swigart of Hyde & Swigart in San Diego.
