LOS ANGELES – A Los Angeles County couple claims a debt collector continued to call after they revoked their consent.
Lourdes Andrade and Jose Andrade filed a complaint on Feb. 27 in the U.S. District Court for the Central District of California against Discover Financial Services citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiffs allege that beginning in 2016 they suffered damages from receiving several collection calls from the defendant in its attempt to collect a debt allegedly owed by Lourdes Andrade. The plaintiffs hold Discover Financial Services responsible because the defendant allegedly kept on calling the plaintiffs despite their repeated request to stop calling and called with a frequency to constitute harassment.
The plaintiffs request a trial by jury and seek injunction against the defendant, statutory damages, treble damages, all legal fees, interest and any other relief as the court deems just. They are represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
