LOS ANGELES – A Commerce corporation alleges an online retailer is unlawfully using its trademark to sell apparel.
Color Image Apparel Inc. filed a complaint on March 7 in the U.S. District Court for the Central District of California against Cassandra Connors and Does 1 through 10 alleging trademark infringement and other counts.
According to the complaint, the plaintiff alleges that it is the owner of the Bella mark for apparel. The plaintiff holds Connors and Does 1 through 10 responsible because the defendants allegedly are likely to cause confusion among consumers because they are operating under the name Bella Bag.
The plaintiff requests a trial by jury and seeks enjoin the defendants, order the defendants to deliver for destruction all infringing products, pay the plaintiff all profits, and damages, interest, all legal fees and any other relief as the court deems just.
