LOS ANGELES – A Canoga Park resident alleges he was called hundreds of times by a debt collector in its attempt to reach an unknown party.
Daniel Logan filed a complaint on March 15 in the U.S. District Court for the Central District of California, Western Division against Citibank NA and Does 1 through 10 alleging violation of Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices.
According to the complaint, the plaintiff alleges that beginning in July 2015, he suffered damages from receiving several collection calls for a debt he does not owe. The plaintiff holds Citibank NA and Does 1 through 10 responsible because the defendants allegedly called the plaintiff more than 400 times despite being informed that he is not the person it is trying to reach.
The plaintiff requests a trial by jury and seeks injunction against the defendant, actual damages, $500 in statutory damages, treble damages of $1,500, interest, all legal fees and any other relief as the court deems just.
