LOS ANGELES – Beachbody, a Santa Monica health, wellness and fitness company, alleges counterfeit versions of its exercise DVDs are being sold online.
Beachbody LLC filed a complaint on March 15 in the U.S. District Court for the Central District of California, Western Division against Jadee Investments Corp., William Lee, Kayo Cleveland and Does 1-10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation. The plaintiff holds Jadee Investments Corp., Lee, Cleveland and Does 1-10 responsible because the defendants allegedly operate websites where they sell counterfeit copies of plaintiff's products.
The plaintiff requests a trial by jury and seeks award profits and damages to the plaintiff, actual damages, statutory damages, injunction against the defendant, treble damages, exemplary or punitive damages, all legal fees and any other relief as this court deems just.
