C.E.S.M. Inc. alleged to have failed to pay contributions

LOS ANGELES – A Monrovia employer is alleged to owe more than $60,000 in contributions to labor union funds.

Trustees of the Operating Engineers Pension Trust, et al. filed a complaint on March 17 in the U.S. District Court for the Central District of California against C.E.S.M. Inc. alleging breach of written contract.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions. The plaintiffs hold C.E.S.M. Inc. responsible because the defendant allegedly breached its bargaining agreement by failing to pay fringe benefit contribution on behalf of its employees.

The plaintiffs seek unpaid fringe benefit contribution in the sum of $64,226.55, liquidated damages of $6,945.48, interest, damages of $62,445.63, all legal fees, and any other relief as the court deems just. They are represented by Michael Y. Jung of Laquer, Urban, Clifford, & Hodge LLP in Pasadena.
