Phoenix Entertainment Partners alleges business, individuals are using counterfeit karaoke products

LOS ANGELES – A Pineville, North Carolina company claims a Huntington Beach establishment hired individuals for karaoke entertainment that used counterfeit versions of its karaoke tracks.

Phoenix Entertainment Partners LLC filed a complaint on March 15 in the U.S. District Court for the Central District of California against Tumbleweeds Bar and Grill LLC, doing business as Tumbleweeds Bar and Grill; Don Stokes, doing business as Sin.Dicate; and Erin Dawn Wilson, also known as Echo Wilson alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its Sound Choice mark being used without its permission. The plaintiff holds Tumbleweeds Bar and Grill LLC, doing business as Tumbleweeds Bar and Grill; Stokes, doing business as Sin.Dicate; and Wilson responsible because the defendants allegedly repeatedly displayed plaintiff's Sound Choice mark on the counterfeit karaoke services they provide.

The plaintiff requests a trial by jury and seeks award profits and damages to the plaintiff; statutory damages not less than $50,000 per defendant; treble, punitive, or otherwise enhanced damages; order all infringing materials to be delivered up for destruction; injunctive relief; all legal fees and any other relief as the court deems just.
