Man alleges disability benefits claim was wrongfully denied

SACRAMENTO – A West Sacramento man alleges his claim for long-term disability benefits was wrongfully denied.

David Scott filed a complaint on March 15 in the U.S. District Court for the Eastern District of California against The Northwestern Mutual Life Insurance Co., Bowen Scarff Ford Lincoln Long Term Disability Benefits Plan alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he had to resign from his job in 2015 because of complications of and treatment for cancer.

The plaintiff holds The Northwestern Mutual Life Insurance Co., Bowen Scarff Ford Lincoln Long Term Disability Benefits Plan responsible because the defendants allegedly wrongfully denied his long-term disability benefit claim and upheld their decision to deny plaintiff's disability benefits despite having sufficient medical proof.

The plaintiff seeks an order for the defendants to pay disability benefits to the plaintiff, injunctive relief, interest, all legal fees and any other relief as the court deems just. He is represented by Jesse S. Kaplan of Jesse S. Kaplan in Carmichael.
