Man claims Winnebago motor home is defective, seeks rescission of sales contract

SACRAMENTO – A Sacramento County consumer claims the motor home he purchased is defective and has not been repaired.

Ronald Short filed a complaint on March 16 in the U.S. District Court for the Eastern District of California against Winnebago Industries Inc. and Stier's RV Center LLC citing the Magnuson-Moss Warranty Act and the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that in 2015, he purchased a 2015 Itasca Sunstar 30T for more than $99,000, which was manufactured by Winnebago. The plaintiff holds Winnebago Industries Inc. and Stier's RV Center LLC responsible because the defendants allegedly failed to fix the defects of plaintiff's motor home despite taking it to an authorized repair facility.

The plaintiff requests a trial by jury and seeks restitution, incidental, consequential damages, actual and statutory damages, all legal fees, and any other relief as the court deems just.
