Woman alleges she did not receive all installments of her employer contribution account

SAN FRANCISCO – A Dublin woman alleges that she has not received the proper amount from her employer contribution account.

Linda Koeplin filed a complaint on March 21 in the U.S. District Court for the Northern District of California against Bayside Solutions Long-Term Incentive & 401(k) Restoration Plan and Robert Klotz citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she suffered damages from having a portion of her benefits withheld. The plaintiff holds Bayside Solutions Long-Term Incentive & 401(k) Restoration Plan and Klotz responsible because the defendants allegedly refused to recognize plaintiff's vested status and refused to pay her the first five annual installments of her employer contribution account.

The plaintiff seeks pay additional benefits to the plaintiff plus interest, declare plaintiff's rights to receive future benefits, pay the plaintiff a penalty of $110 per day for each day from Dec. 8, 2016, all legal fees and any other relief as the court deems just. She is represented by Teresa Renaker, Margo Hasselman Greenough and Kirsten Scott of Renaker Hasselman Scott LLP in San Francisco.
