Buyer claims he was damaged by purchase of counterfeit books through Amazon

LOS ANGELES – A Malibu man alleges he purchased counterfeit textbooks on Amazon that were marketed as authentic.

Peter King filed a complaint on March 20 in the U.S. District Court for the Central District of California against Amazon.com Inc. alleging trademark infringement, common law fraud and negligent misrepresentation.

According to the complaint, the plaintiff alleges that he purchased 141 copies of "Principles of Macroeconomics" at $100 per book through the Amazon.com marketplace. The suit states he resold the books to two third parties and was later contacted by lawyers with allegations that the books were counterfeit. He states he contacted Amazon for a refund, which it originally agreed to, but later rescinded the offer.

The plaintiff requests a trial by jury and seeks damages, restitution, exemplary damages, actual damages, statutory damages, interest, punitive damages, all legal fees and any other relief as the court deems just. He is represented by Luis F. Magdaleno of Magdaleno Law Office in San Diego.
