LOS ANGELES – A Los Angeles company alleges a retailer unlawfully copied one of its pendant designs.
LA Gem & Jewelry Design Inc. filed a complaint on March 20 in the U.S. District Court for the Central District of California against Claire's Boutiques Inc., doing business as Claire's Accessories, Claire's and Claire's Stores Inc.; CBI Distributing Corp.; Claire's Accessories UK LTD; and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its Moon Pendant design copied. The plaintiff holds Claire's Boutiques Inc., doing business as Claire's Accessories, Claire's and Claire's Stores Inc.; CBI Distributing Corp.; Claire's Accessories UK LTD; and Does 1-10 responsible because the defendants allegedly duplicated plaintiff's Mood Pendant and sells it as their own design.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's design, award damages to the plaintiff plus profits, statutory damages, interest, all legal fees and any other relief as the court deems just.
