Wongab Corp. claims H&M infringed patented fabric patten

LOS ANGELES – H&M is accused of infringing a Korean company's textile design.

Wongab Corp. filed a complaint on March 22 in the U.S. District Court for the Central District of California against H&M Hennes & Mauritz AB, H&M Hennes & Mauritz LP and Does 1-10 alleging copyright infringement and patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its patented design copied. The plaintiff holds H&M Hennes & Mauritz AB, H&M Hennes & Mauritz LP, and Does 1-10 responsible because the defendants allegedly used a warp knitted fabric design that infringes plaintiff's patented design.

The plaintiff requests a trial by jury and seeks award all profits to the plaintiff, damages, profits, enjoin the defendant, treble damages, all legal fees, interest and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
