BCBG Max Azria Group accused of copyright, patent infringement with use of fabric design

Patents 03

LOS ANGELES – A Korean corporation claims that one of its patented knitting fabric designs and one of its textile designs were unlawfully used.

Wongab Corp. filed a complaint on March 22 in the U.S. District Court for the Central District of California against BCBG Max Azria Group LLC and Does 1-10 alleging copyright and patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its textile designs being copied. The plaintiff holds BCBG Max Azria Group LLC and Does 1-10 responsible because the defendants allegedly owns a warp knitting fabric design that infringes plaintiff's designs.

The plaintiff requests a trial by jury and seeks to enjoin the defendant, pay all profits to the plaintiff, enhanced and elevated damages, all legal fees, profits, treble damages, and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
