Musician alleges unlawful use of its La Migra mark

LOS ANGELES – A Ventura County musician alleges a Los Angeles County man is unlawfully using his trademark.

Carlos Martinez Somoza filed a complaint on March 22 in the U.S. District Court for the Central District of California against the J. Sergio Rios Gutierrez and Does 1-10 alleging trademark infringement, unfair competition, false advertising and other counts.

According to the complaint, the plaintiff alleges that he and other musicians have been performing under the La Migra name since 1975. The suit states the defendant is using the name Grupo La Migra. The plaintiff holds Gutierrez and Does 1-10 responsible because the defendant's use of the La Migra name allegedly caused confusion and damage to the plaintiff's reputation and mark.

The plaintiff requests a trial by jury and seeks enjoin the defendant, injunction, all legal fees, and any other relief as this court deems just. He is represented by Steven J. Eyre in Los Angeles.
