Walmart garments allegedly use infringing copies of New York corporation's lace designs

LOS ANGELES – A New York corporation alleges infringing copies of one of its lace designs were used on garments sold at Walmart stores.

Klauber Bros. Inc. filed a complaint on March 23 in the U.S. District Court for the Central District of California against Topson Downs of California Inc., Wal-Mart Stores Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its 7010 lace design copied. The plaintiff holds Topson Downs of California Inc., Wal-Mart Stores Inc. and Does 1 through 10 responsible because the defendants allegedly sells garments through defendant Walmart stores that feature plaintiff's lace designs without authorization.

The plaintiff requests a trial by jury and seeks enjoin the defendants, all profits, monetary advantages, statutory damages, all legal fees, interest and any other relief as the court deems just. It is represented by Scott Alan Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
