Rex Fabrics alleges unlawful use of tie-dye fabric design

LOS ANGELES – A Los Angeles County corporation claims a New Jersey company copied one of its fabric designs without authorization.

Rex Fabrics filed a complaint on March 23 in the U.S. District Court for the Central District of California against Costume Gallery Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its tie-dye fabric design copied. The plaintiff holds Costume Gallery Inc. and Does 1 through 10 responsible because the defendants allegedly sold garments that feature plaintiff's fabric design.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, award all profits, statutory damages, all legal fees, interest, and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott Alan Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
