Man alleges he does not owe debt to Cavalry Portfolio Services, Winn Law Group

Late 06

LOS ANGELES – A debt collector is accused of garnishing a Los Angeles County man's wages over a debt he alleges he does not owe.

Jason Franklin filed a complaint on March 22 in the U.S. District Court for the Central District of California against Cavalry Portfolio Services LLC, Winn Law Group and Does 1-10 citing the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in February, the defendant garnished his wages for a debt he alleges he does not owe. The suit states the defendants obtained a judgment against him and that he was not served or made aware of it. The plaintiff holds Cavalry Portfolio Services, LLC; Winn Law Group, and Does 1-10 responsible because the defendants allegedly falsely represented the character, amount and legal status of the debt.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, all legal fees, and any other relief as the court deems just. He is represented by Todd M. Friedman and Adrian R. Bacon of Law Offices of Todd M. Friedman PC in Woodland Hills.
