Rash Curtis & Associates faces class action over collection calls

SACRAMENTO – A Tulare County consumer has filed a class-action lawsuit against a debt collector over the allegedly frequent calls it made to her cellphone.

Amy Vidrio filed a complaint on behalf of all others similarly situated on March 20 in the U.S. District Court for the Eastern District of California against Rash Curtis & Associates and Does 1 through 10 citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in July 2016, she suffered damages from being called several times by the defendants their attempt to collect an alleged debt. She alleges the communications were frequent enough to be considered harassment. The plaintiff holds Rash Curtis & Associates and Does 1 through 10 responsible because the defendants allegedly kept on calling the plaintiff despite her request to stop calling her.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, actual damages, all legal fees and any other relief as the court deems just.
