Folsom resident says marketing company made solicitation calls despite being on do not call list

SAN DIEGO — A Folsom woman has filed a class-action lawsuit against a marketing company, citing alleged violation of telephone harassment statutes.

Susan Hayes filed a complaint on behalf of all others similarly situated on March 23 in the U.S. District Court for the Eastern District of California against The Health Enrollment Group Inc. and Does 1-10,  alleging that they called the plaintiff several times in an attempt to offer their services to her.

According to the complaint, the plaintiff alleges that starting on Aug. 10, she suffered damages from receiving unwanted calls. The plaintiff holds The Health Enrollment Group and Does 1 through 10 responsible because the defendants allegedly made several solicitation calls to the plaintiff's home phone despite being added to the do not call registry.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, all legal fees and any other relief as this court deems just. She is represented by Todd M.
